These Terms of Service govern the use of thepatrace.com (the “Website”), published by Patrizia Spagnolo Plaza, Entrepreneur Individuel (EI), trading as Patrace. By using the Website, you agree to these terms.

1. Scope

These terms apply to browsing the Website, reading The Archive, subscribing to the newsletter and submitting inquiry or contact forms.

Other engagements are governed by their own documents:

• The Studio: strategic and creative services are governed by the individual proposal and agreement signed with each client.
• The Foundry: purchases of digital products are governed by the Terms of Sale.

2. Access to the Website

The Website is available free of charge, apart from the cost of internet access. Patrace works to keep the Website available and accurate, and may update, suspend or modify it at any time, including for maintenance.

3. Content and information

Content published on the Website, including The Archive, is provided for general information and reflects Patrace’s point of view. It is general in nature and does not constitute advice tailored to a specific business. Decisions made on the basis of this content remain the responsibility of the reader.

4. Intellectual property

The Website and its content, including texts, articles, images, designs, frameworks, templates, the names Patrace, The Studio, The Archive, The Foundry and The Patrace Method™, and the Patrace logo, are protected by intellectual property law and belong to Patrace or its licensors.

You may read the content, and share links to it, for personal and non-commercial purposes. Short quotations are welcome when Patrace is credited and linked. Any other reproduction, adaptation, distribution or commercial use requires the prior written consent of Patrace.

The license granted for products purchased from The Foundry is defined in the Terms of Sale.

5. Use of the Website

When using the Website, you agree to:

• use it in accordance with applicable laws;
• provide accurate information in forms;
• respect the security and integrity of the Website and its systems;
• use the content only within the limits set out in section 4.

6. Forms and communications

Information submitted through inquiry, contact or diagnostic forms is used to respond to your request and is processed as described in the Privacy Policy. Submitting a form does not create a contractual relationship. A collaboration with The Studio begins only once a proposal and agreement have been accepted.

Newsletter subscribers can unsubscribe at any time through the link included in each email.

7. External links

The Website may contain links to third-party websites and platforms, such as Instagram, Pinterest, LinkedIn or online marketplaces. Patrace has no control over their content or practices, which are governed by their own terms.

8. Liability

Patrace takes care to provide accurate and up-to-date information and a secure Website. Patrace’s liability cannot be engaged for temporary unavailability, technical issues beyond its control, the use of information published on the Website, or the content of third-party websites. Nothing in these terms limits the rights granted to consumers by law.

9. Personal data

Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and French law, as described in the Privacy Policy and the Cookie Policy.

10. Changes to these terms

Patrace may update these Terms of Service to reflect changes to the Website or to applicable law. The version in force is the one published on the Website, with its date of last update.

11. Applicable law and disputes

These Terms of Service are governed by French law. Any dispute is first addressed amicably by writing to contact@thepatrace.com. Failing an amicable resolution, the competent French courts have jurisdiction, subject to the mandatory rules protecting consumers.
